FREUND, FREEZE & ARNOLD WINS ON SUMMARY JUDGMENT, UPHELD ON APPEAL

Dayton, Ohio,

Freund, Freeze & Arnold attorneys Neil F. Freund and Kelly M. Schroeder prevailed on a motion for summary judgment filed in favor of their clients in a legal malpractice case in Miami County, Ohio. Recently, they also prevailed on the appeal to the Second District Court of Appeals.

The plaintiff argued his attorney was negligent in handling a settlement in a breach of contract case. Freund and Schroeder argued the attorney was not negligent, the plaintiff’s case was not ripe, and in any event, the plaintiff could not prevail on his claim for damages. The trial court agreed and dismissed the case. The plaintiff appealed, and Kelly Schroeder briefed and argued the case to the Second District Court of Appeals. The Court of Appeals agreed with the defense, affirmed the decision of the trial court, and issued a Final Entry fully dismissing plaintiff’s legal malpractice case.
