A Mason County, Kentucky jury returned a verdict in favor of Dr. Mathew Shotwell and released him and Ohio Valley Heart from any liability stemming from the death of Donald Bellamy in late 2003. The suit was filed against Shotwell in September, 2004, about a year after 49-year-old Donald Bellamy died as a result of a ruptured pseudoaneurysum following a stenting procedure performed in Cincinnati but not performed by Shotwell.
In the suit, the plaintiffs alleged Shotwell's negligence was ultimately liable for Donald Bellamy's death. The suit sought compensation for medical expenses, funeral expenses, pain, suffering and lost wages.
Mark MacDonald of Freund Freeze & Arnold of Cincinnati, attorney for Shotwell said, "We believe we had an excellent jury who used their unwavering attention to return a very fair and reasonable verdict. It has truly been a privilege to represent Dr. Mathew Shotwell and this community should consider itself extremely lucky to have such a valued member of the medical community."
